3. How We Collect Information

Personal information is collected exclusively through the contact form on this website. The contact form is processed by FormSubmit (formsubmit.co), a USA-based form processing service that forwards your submission to our email address. We do not collect personal information through any other automated means.

You are not required to provide personal information to browse this website. Personal information is only collected when you voluntarily submit the contact form.

4. Legal Basis for Processing

Under PIPEDA, personal information may be collected with the knowledge and consent of the individual. Our legal basis for collecting and using your personal information is:

  • Consent: By submitting the contact form, you consent to the collection and use of your personal information for the purpose of responding to your inquiry. You may withdraw your consent at any time (see Section 10).
  • Contractual necessity: When you engage Seideldexa for a Project, we process personal information as necessary to perform our obligations under the service agreement (see Terms of Service).
  • Legal obligations: We retain certain records as required by the Canada Revenue Agency for tax compliance purposes.

5. Purpose of Collection

We collect and use personal information for the following purposes only:

  • To respond to your inquiry and communicate with you about potential projects.
  • To prepare and deliver Scope Proposals.
  • To perform services under an agreed project engagement.
  • To issue invoices and process payments.
  • To comply with legal and regulatory obligations, including tax record-keeping requirements of the Canada Revenue Agency.

We do not use your personal information for marketing purposes unless you have given explicit consent. We do not sell, rent, trade or otherwise disclose your personal information to third parties for their own marketing purposes.

6. Data Retention

We retain personal information only for as long as necessary to fulfill the purposes for which it was collected:

  • Contact form inquiries: Retained for twelve (12) months from the date of submission. After this period, the inquiry and associated personal data are permanently deleted.
  • Project records and invoices: Retained for seven (7) years from the end of the fiscal year in which the transaction occurred, as required by the Canada Revenue Agency (CRA) for tax record-keeping purposes under the Income Tax Act.
  • Deliverables archive: Project deliverables are archived for twenty-four (24) months from the delivery date, as described in our Terms of Service, Section 9.

When the retention period expires, personal information is securely deleted or anonymized so that it can no longer be associated with an identifiable individual.

7. Third-Party Service Providers

We share personal information with the following third-party service providers, who act as data processors on our behalf:

FormSubmit (formsubmit.co)

  • Service: Contact form processing. When you submit the contact form, your name, email, phone number and message are transmitted through FormSubmit's servers to our email inbox.
  • Location: United States of America.
  • Safeguards: Because FormSubmit is based in the USA, your personal information may be processed outside of Canada. The USA does not have privacy legislation considered equivalent to PIPEDA by the Government of Canada. However, FormSubmit processes data in transit only (forwarding to our email) and does not store submissions long-term. We have assessed this transfer and determined that adequate safeguards are in place, including encryption in transit (TLS/SSL). By submitting the contact form, you acknowledge and consent to this transfer.

HostPapa Inc.

  • Service: Website hosting.
  • Location: 115 George Street, Suite 511, Oakville, Ontario L6J 0A2, Canada.
  • Safeguards: HostPapa is a Canadian company and your data is processed within Canada, subject to PIPEDA.

We do not share personal information with any other third parties. We do not use analytics services, advertising networks or social media tracking tools on this website.

8. International Data Transfers

As described in Section 7, contact form submissions are processed through FormSubmit, a USA-based service. This means your personal information may be temporarily transferred to and processed in the United States. Canada is not in the European Union, and this website is governed by Canadian privacy law (PIPEDA), not the EU General Data Protection Regulation (GDPR). However, our privacy practices align with internationally recognized privacy principles, including purpose limitation, data minimization and individual access rights.

9. Your Rights Under PIPEDA

Under the Personal Information Protection and Electronic Documents Act (PIPEDA), you have the following rights regarding your personal information:

  • Right of access: You may request access to the personal information we hold about you. We will respond within thirty (30) calendar days of receiving your request.

  • Right to deletion: You may request the deletion of your personal information, subject to any legal retention obligations (such as the 7-year CRA tax record requirement).
  • Right to withdraw consent: You may withdraw your consent to the collection, use or disclosure of your personal information at any time, subject to legal or contractual restrictions. Withdrawal of consent may affect our ability to provide services to you.
  • Right to information: You may ask us to explain our personal information handling practices and policies.
